It has not made a lot of noise in the main stream media, but recently, an important case filed jointly by the ACLU and the Center for Constitutional Rights challenging the Department of Justice and the Obama Administration’s drone war was argued in front of Judge Rosemary Collyer. That case is Anwar Al-Aulaqi vs. Panetta, et al and it was filed in the United States District Court for the District of Columbia in 2012. You can find the filing here.

What makes this case so important is that it was filed on behalf of the estate of a 16-year-old American citizen who was killed by an American drone strike, along with other victims, in Yemen in 2011. Recently the United States Department of Justice presented a defense that is quite striking. Read more of this post

Driver License Suspension: Debt Bondage for Modern Times?

wadlDrivers are subject to license suspension for a variety of legitimate reasons: Conviction for a criminal traffic offense; interests of safety; and for other administrative violations. Essentially it could be ranked into two categories: safety or punitive. While the former is generally not controversial, the implementation of the latter is generally understood to be reasonable. But, in some situations it can be argued by some to be a form of bondage involving what leads to a multi-year ordeal of suspension where the licensee is held in demand for increasing levels of penalties owed to the state, placing what could be argued to be a vicious cycle of artificially created debt that many find difficult to satisfy.

A significant issue in several states lies with the revolving door of driver license suspensions. A typical example would be a defendant who is cited for a violation and receives a license suspension as a penalty. Often there is a monetary fine that must be paid in addition to other sanctions to receive the license reinstatement. Often times these fines are of such cost that those subject to license suspension have difficulty paying and therefore their license and consequently their livelihood is taken away. Often what starts as a simple traffic ticket that goes unpaid leads to effectively a debt bondage, where the driver is required to pay increasing fines, interest, and assessments with little for relief.

Is it just me, or is it warm in here?

NASA logoNOAA logoApproximately 1,000 weather reporting stations all over the world have been monitoring local temperatures for decades. Temperature data have been compiled and analyzed by NASA scientists at NASA’s Goddard Institute for Space Studies (GISS) in New York.

Nine of the 10 warmest years on record have occurred since the year 2000. The tenth? From the 20th Century, that was 1998. Temperature rise is not completely steady and consistent from one year to the next. That is due to factors such as volcanic eruptions and other natural causes; however, trends are the important thing.

We can see from the short video below the flip that Earth continues to experience warmer temperatures than several decades ago. The average temperature around the globe in 2011 was 0.92 degrees F (0.51 C) warmer than the mid-20th century baseline. Weather experts warn that a consistent global average change of even a half-degree Fahrenheit can have catastrophic effects on global weather patterns. Anyone recall April and May 2011?

Stateside Kentucky: Critics of the New Generation Science Standards Claim They Are Atheistic, Fascistic, and Could Lead to Genocide

In late July in Frankfort, Kentucky, supporters and critics of the Next Generation Science Standards clashed during a hearing over proposed changes that could be made to the science curriculum of the state’s public schools. The new science standards were developed with input from officials in Kentucky and twenty-five other states with the hope of making science curricula “more uniform across the country.”

Those who spoke in support of the new education standards said they are “vital if Kentucky is to keep pace with other states and allow students to prepare for college and careers.” Supporters feel the new standards “will help beat back scientific ignorance.” Critics—on the other hand—claimed that the new standards were “fascistic” and “atheistic” and promoted thinking that could lead to “genocide” and “murder.”

According to the Courier-Journal, nearly two dozen parents, teachers, scientists, and advocacy groups commented during the Kentucky Department of Education hearing on the Next Generation Science Standards—which are a broad set of guidelines that were developed in order to revise K-12 science content that would meet the requirements of a 2009 law, which called for educational improvement.

keysThe U.S. government has demanded that internet companies turn over their master encryption keys that are used to secure Web communication. Web encryption is active when an HTTPS appears on the URL. The technique is called SSL, or Secure Sockets Layer. For example, HTTPS encrypts communications only between the browser and Gmail’s servers. With the master keys, decryption of the contents of the intercepted communication is possible. "Strongly encrypted data are virtually unreadable," according to NSA director Keith Alexander. The internet is fast becoming an encrypted model as more internet companies adopt SSL.

Call Me Queer

391px-Stonewall_Inn_1969As you know part of my contribution as a guest blogger has been the fact that I write much from personal experience. This particular blog is one that I’ve thought about for awhile and have had some trepidation in writing because as you will see it touches on a very sensitive topic for most males. As a boy coming of age in the 1950’s one of the unvoiced, but omnipresent topics was male homosexuality. For a male growing up in that period, among the most upsetting epithets you could be called was queer. This was especially disturbing for those entering puberty, which in the 50’s context was coming into the macho essence of your own self worth. If you were queer you were deemed to be less of a male, a wimp, a fag and most essentially a loathsome pervert who did disgusting things with other males. People were bullied and beaten at school while being called degrading names. Even though I was always big for my age, I was a gentle and sensitive boy and while when attacked I would always fight back, I would be throwing punches through tears of frustration and rage at the injustice of it all. As I cried and fought, all those demeaning epithets would be hurled at me by the jeering bystanders. If I had the temerity to be winning, then other boys would attack me from behind. Finally, a teacher or Administrator would break it up, many times though my rescuer would sneer at the fact that my crying was “unmanly”. Read more of this post

Now there are reports The Putin governments alliance with the Russian Orthodox Church has expressed itself in the abusive prosecution of the band Pussy Riot as well as the crackdown on gays and lesbians. Now these reports detail videotapes of gay men being forced to drink urine and abused as a "cure" of their homosexuality.

Prosecutors often look at whether an interstate road was used in a crime, but what is the crime is the interstate road? It may sound like a Yakov Smirnoff skit ("In Russia, you don’t steal away on the road, the road . . . ") but in Syktyvkar, Russia a man was arrested for stealing 82 reinforced concrete slabs that made up a road outside of a city.

Thus, we saw how "hold down the fort" have been declared unacceptable by Obama Administration officials as racist. In Seattle, the language police have added terms like "citizen" and "brown bag" as racist or offensive. They are to be banned from public documents and discussions by order of the Seattle officials in the city’s Office of Civil Rights. By the way, they might want to start with the city council, which routinely holds "brown bag" lunches.

DOJ Memo Reveals Effort To Block Trotsky Speech

220px-Trotsky_Portrait225px-fdr_in_1933The Atlantic Magazine has an interesting article out this week on a little known effort by the Administration to stop Americans from listening to a speech in Mexico by Leon Trotsky that would be transmitted over a telephone line. Assistant Solicitor General Golden W. Bell wrote the memo below stating that the Administration had no such authority. That was before the Office of Legal Counsel and the rest of the Department became more ambitious and less principled. Today they can find interpretations to allow the circumvention of the separation of powers, the assassination of citizens, the establishment of a torture program, and the maintenance of an Imperial Presidency.

An Illinois family found the fawn and brought it to the the Society of St. Francis shelter a couple weeks ago. The shelter planned to take the fawn named Giggles to a wildlife shelter. However, the DNR learned of the plan and, according to the shelter, raided the facility and killed the fawn.

228px-Picture_of_Edward_SnowdenIt is now confirmed that NSA whistleblower Edward Snowden has been granted temporary asylum in Russia and has left Moscow’s Sheremetyevo International airport. The United States continues to threaten any country that grants Snowden asylum and has been successful in pressuring U.S. media never to refer to him as a whistleblower. While MSNBC hosts mock Snowden and express disbelief why he doesn’t just trust that Obama will give him a fair trial, there is little reason for Snowden to trust those assurances when a president is claiming the right to kill citizens without trial, send some people to military tribunals, and routinely uses classification laws to force the dismissal of public interest lawsuits. What’s not to trust?

Meet XKeyscore: The Latest Massive Surveillance Program Of U.S. . . . As Reported In The Foreign Media

President_Barack_ObamaNational_Security_Agency.svgThis morning we have yet another article detailing a warrantless surveillance program by the National Security Agency that contradicts representations made by President Barack Obama and members of Congress. You may recall how Obama has tried to get citizens to embrace a new surveillance-friendly model of privacy after the disclosure of massive surveillance of citizens, including programs acquiring every call made by citizens. Various Democratic members came forward to admit that they knew of such programs and not to be afraid . . . they have our backs. Yet every story that has surfaced has contradicted claims that such programs are limited and do not involve the content of communications in emails and messages. The latest program being reported is called XKeyscore and is described as scouring emails, chat rooms, and browsing histories . . . all without a warrant. In the meantime, citizens in polls are saying that they are more concerned with the threat of their own government to their privacy than the threat of terrorism. Once again, citizens learned of this program not from their representative or their media but largely from the foreign press and the disclosures of Edward Snowden.

The two women were hiking in Maine when they became lost. They were rescued only to get into their car and drive of a boat ramp and drown. Adding to the tragedy, Stiner was four months pregnant. Moyer left behind a 12 year old son.

badawiRaif Badawi, who started the ‘Free Saudi Liberals’ website to discuss the role of religion in Saudi Arabia, has been sentenced to a Saudi "court" to seven years in prison and 600 lashes for his engaging in free speech. It is the latest outrage from our closest Arab ally. Yet, we continue to treat Iran as part of the axis of evil while our allies deny basic rights and enforce draconian Medieval laws against dissidents and non-believers.

Bradley ManningAfter years of abuse in confinement from denying him a charge to denying him counsel, Pfc. Bradley Manning finally had a trial on the most serious charge against him: aiding the enemy. He was convicted on lesser charges. The verdict should again focus attention on the mistreatment of Manning by the Obama Administration for leaking classified reports and diplomatic cables. Many of these documents showed that the U.S. government was lying to the public and to its allies.

Lapd_badgeBrian Cisneros, 34, is accusing the Los Angeles Police Department of assaulting him without provocation last week. Cisneros says that he was riding his bike when officers allegedly jumped out of a cruiser and beat him severely. He was charged with “for no lights after hours of darkness.” He has charged the officers with police abuse in a complaint.

California Judge Approves Two Charges Of Manslaughter Against Driver In The Electrocution Of Two Good Samaritans

staceyirmaThere is a tragedy in California that has led to a particularly challenging question of proximate causation. It appears well established that Arman Samsonian, 19, was driving recklessly when he slammed his SUV into a utility pole and a fire hydrant. It was a bad combination. When two individuals ran over to help, they were both electrocuted to death by the electrified water from the hydrant in contact with a fallen wire. Los Angeles Superior Court Judge Karen Nudell last week approved charges of vehicular manslaughter with gross negligence for the deaths of good Samaritans, Irma Zamora (right) and Stacey Schreiber (left). The defense insists these were unforeseeable intervening acts that should not be the basis for criminal charges.

225px-Vladimir_Putin_official_portrait250px-Esox_lucius1In his embarrassing quest to become something of a Russian action figure, Vladimir Putin has been featured a race car driver, great white hunter, jet pilot, oceanologist, martial artist and Hell’s Angel. During one such stunt Putin was shown as a scuba diver where he retrieved perfectly preserved ancient jars from the Ocean floor. His aides swore to a skeptical public that nothing was staged. Of course, it was shown later that the whole thing was staged. Now, aides are wondering why no one seems to believe them that Putin caught a record-setting pike. Professional fisherman cried foul at the latest Putin fish story.

Just When You Thought The Weiner Scandal Could Not Get Creepier . . .

250px-Creepy1220px-AnthonyweinerOk, after seeing these high resolution pictures of narcissism on parade, I have decided that Anthony Weiner and Sydney Leathers are made for each other. Leathers is now reportedly considering a porn career. In the meantime, there appears one group that remains enthusiastic about Weiner. Believe it or not, it is women aged 18-36 which give him a 78 percent favorable rating according to a poll by a dating site. Putting aside the skewed population for the poll, it is still pretty disheartening.

Many cases are built virtually entirely on such testimony of jailhouse confessions or stings using such unreliable individuals.
